Swiss Federal Tribunal, 20 July 2017, Russian Federation v. Yukos, 4A_98/2017

The Swiss Federal Tribunal dismissed a request for annulment filed by Russia against an award on jurisdiction dated 18 January 2017 rendered by an Arbitral Tribunal seated in Geneva under the auspices of the PCA.
In its interim award on jurisdiction the Arbitral Tribunal had only ruled over three jurisdictional objections out of five (the other two are to be treated with the merits of the
case). However, the Federal Tribunal concluded that such an “incomplete” award could not be challenged. Moreover, the Federal Tribunal decided that the suspension of the annulment proceedings, until the final decision of the Arbitral Tribunal on its own jurisdiction, was not possible.
