Another court in this case transmitted a question of constitutionality to the Cour de Cassation. The First President of the Court of Appeal of Paris ordered the reopening of the proceedings on the stay of execution of the awards that Commisimpex engaged against Congo seizing the debts of a third party towards it. The question of constitutionality is whether a requirement under customary international law of express waiver of immunity complies with paragraph 14 of the Preamble to the French Constitution, according to which “the French Republic, faithful to its traditions, complies with the rules of international public law”.
