It is possible to request an interim measure to obtain information in order to facilitate the
enforcement of an award, which has become enforceable in France, under Articles 809 and 812 of the French Code of Civil Procedure, before a “motion” judge. This is justified by the fact that the arbitral tribunal ruled on all the submitted requests.
Besides that, this measure definitely falls within the framework of the enforcement of the arbitral award. Nonetheless, it is not typically used to resolve any trouble with enforcement but rather to allow the extension of the already exercised attachments. Hence, the enforcement judge (juge de l’exécution) does not have exclusive jurisdiction.
